Terms and Conditions.

These terms and conditions of sale are concluded, on the one hand, by the company Pavenrod, with share capital of €6,500, whose registered office is located at 180 rue du genevois, 73000 Chambéry, registered with the Chambéry Trade and Companies Register under number 984894667, hereinafter referred to as "Pavenrod" and managing the website pavenrod.fr, and, on the other hand, by any natural or legal person wishing to make a purchase via the website pavenrod.fr, hereinafter referred to as "the buyer".

Article 1. Purpose

These terms and conditions of sale define the contractual relationship between Pavenrod and the buyer, and the conditions applicable to any purchase made through the website pavenrod.fr. The acquisition of a product through this site implies unreserved acceptance by the buyer of these terms and conditions of sale, which the buyer acknowledges having read prior to placing an order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the pavenrod.fr website is unrelated to their professional activity and is limited to strictly personal use, and on the other hand, that they have full legal capacity to enter into these general terms and conditions of sale.

The company Pavenrod reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the buyer's order.

Article 2. Products

The products offered are those listed on the pavenrod.fr website of the company Pavenrod, within the limits of available stock. The company Pavenrod reserves the right to modify the product assortment at any time. Each product is presented on the website with a description outlining its main technical characteristics. Photographs are as accurate as possible but do not bind the Seller in any way. The sale of products presented on the pavenrod.fr website is intended for all buyers residing in countries that fully allow these products to enter their territory.

Article 3. Prices

The prices listed on the product sheets in the online catalog are in Euros (€) inclusive of all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The company Pavenrod reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, which are charged in addition to the price of the products purchased, depending on the total amount of the order. In mainland France, for any order equal to or greater than 150 euros TTC, shipping costs are free; for any order less than 149.99 euros TTC, a fixed contribution to shipping costs of 6 euros TTC will be charged to the buyer.

Article 4. Order and Payment Methods

Before placing any order, the buyer must create an account on the pavenrod.fr website. The account creation section is directly accessible from the side menu bar. With each visit, if the buyer wishes to order or consult their account (order status, profile, etc.), they must identify themselves using this information. The company Pavenrod offers the buyer the option to order and pay for their products in several steps, with 3 payment options to choose from:

- Secure payment by credit card: the buyer selects the products they wish to order in the "cart", modifies if necessary (quantities, references, etc.), verifies the delivery address or enters a new one. Then, shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment by credit card". The next step prompts them to check all information, read and accept these general terms and conditions of sale by checking the corresponding box, then invites them to confirm their order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to a secure interface to securely enter their personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the buyer may request cancellation of the card payment; the sums paid will then be re-credited or refunded. The liability of a credit card holder is not engaged if the disputed payment is proven to have been made fraudulently, remotely, without physical use of their card. To obtain reimbursement for the fraudulent debit and any bank charges that the transaction may have incurred, the cardholder must dispute the debit in writing with their bank, within 70 days of the transaction, or even 120 days if the contract linking them to the bank so provides. The amounts debited are reimbursed by the bank within a maximum of one month after receipt of the written dispute filed by the cardholder. No costs for the restitution of funds may be charged to the cardholder.

Confirmation of an order implies acceptance of these terms and conditions of sale, recognition of having perfect knowledge thereof, and waiver of the right to rely on one's own terms and conditions of purchase. All data provided and the recorded confirmation will serve as proof of the transaction. If the buyer has an email address and has provided it on their order form, the company Pavenrod will send them email confirmation of the registration of their order.

Article 5. Retention of Title

The company Pavenrod retains full ownership of the products sold until full payment of the price, including principal, costs, and taxes.

Article 6. Right of Withdrawal

Pursuant to Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of return shipping costs.

Article 7. Delivery

Deliveries are made to the address indicated on the purchase order, which can only be within the agreed geographical area. Orders are dispatched by La Poste via COLISSIMO, a tracked delivery service without signature. Delivery times are given for information only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The company Pavenrod may provide the buyer with the tracking number of their package by e-mail. The buyer is delivered to their home by their postman. In the absence of the buyer, they will receive a delivery notice from their postman, allowing them to collect the ordered products from the nearest post office, within a period indicated by the postal services. Risks related to transport are borne by the buyer from the moment the items leave the premises of the company Pavenrod. The buyer is required to check the condition of the packaging of the goods and their contents upon delivery, in the presence of the La Poste employee or the delivery person. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by the company Pavenrod benefit from the legal warranty provided by articles 1641 and following of the Civil Code. In case of non-conformity of a sold product, it may be returned to the company Pavenrod, which will take it back, exchange it, or refund it. All claims, requests for exchange or refund must be made by mail to the following address: Pavenrod, 180 rue du genevois, 73000 Chambéry, within thirty days after delivery.

Article 9. Liability

In the distance selling process, the company Pavenrod is bound only by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service disruption, or other involuntary problems.

Article 10. Intellectual Property

All elements of the pavenrod.fr website are and remain the exclusive intellectual property of the company Pavenrod. No one is authorized to reproduce, exploit, or use, for any purpose whatsoever, even partially, elements of the site, whether they are in the form of photos, logos, visuals, or text.

Article 11. Personal Data

The company Pavenrod undertakes to preserve the confidentiality of the information provided by the buyer, which they may be required to transmit for the use of certain services. Any information concerning them is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the internet user has a right to access, modify, and delete information concerning them. Article 12. Dispute Resolution

These distance selling conditions are subject to French law. For all disputes or litigations, the competent court will be that of Chambéry.
